Disclaimer and Indemnity

3.1 Intermediary Status

VisitHartbees (Pty) Ltd operates solely as a booking agent and technology platform. We do not own, manage, operate, or control any of the lodges, boats, restaurants, activity centres, or other partner establishments listed on our platform.

All services, experiences, and accommodations are provided directly by independent third-party partner establishments. VisitHartbees facilitates the booking and payment process only.

3.2 Assumption of Risk

By making a booking, you acknowledge and accept that:

• Activities in the Hartbeespoort region — including but not limited to water sports, jet skiing, boat cruises, wildlife interactions, cableway transit, hiking, and adventure experiences — carry inherent risks of injury, illness, or death.
• You are physically and mentally fit to participate in your chosen activities.
• You have disclosed any relevant medical conditions, allergies, or dietary requirements to VisitHartbees and/or the partner establishment.

3.3 Limitation of Liability

To the fullest extent permitted by South African law:

• VisitHartbees, its directors, employees, agents, and technology developers shall not be held liable for any injury, loss, death, damage to property, or any other claim arising from or connected to services provided by a partner establishment.
• VisitHartbees is not liable for the accuracy of information provided by partners regarding their services, facilities, or safety measures.
• Our total liability in connection with any booking shall not exceed the total amount paid by you for that specific booking.

3.4 Indemnity

By completing a booking on visithartbees.com, you agree to indemnify and hold harmless VisitHartbees (Pty) Ltd, its directors, employees, and technology service providers against any and all claims, damages, losses, costs, and expenses (including legal fees) arising from:

• The service delivery, conduct, or negligence of any third-party partner establishment.
• Your participation in any activity booked through our platform.
• Your breach of these terms or any applicable law.

3.5 Force Majeure

VisitHartbees shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, civil unrest, power failures, or internet outages.
